ORDINANCE NO. 2908

AN ORDINANCE CREATING A PROHIBITION AGAINST PUBLIC NUDITY

THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:

SECTION 1. A new section 10.44.012 of the Ashland Municipal Code is adopted to read:

10.44.012 Public Nudity.
00000 It is unlawful for any person to expose his or her genitalia while on public property in the C-1-D (Downtown Commercial) zone or in a public park. This provision is not intended to apply to a person who is prepubescent or who has taken steps to create an envelope of privacy upon their own property and the nudity occurs within that envelope.

The foregoing ordinance was first read on the 4th day of May, 2004, and duly PASSED and ADOPTED this 15th day of June, 2004.
